Can they fire me if I file a Workers’ Compensation claim against my employer?

Yes! A common misconception among the public is that an employer can’t fire you if you have an open Workers’ Compensation claim against them. Actually, they can fire you for almost any reason except to retaliate against you for having a work injury or claim. Some employers will make up a bogus reason to let you go. Then we will sue the employer for you, but the burden of proof as to the reason for the firing is on the injured worker. Be polite to your employer. The employer has nothing to gain by firing you and much to lose if you prove discrimination, but you are dealing with people. If your employer doesn’t like you, he may invent a good reason for letting you go. However, if the employer loses a discrimination case, your claim’s value will increase by 50% or ten thousand dollars, whichever is less.

Can I get stuck with doctor bills if I lose my case?

Not if they were truly incurred as a result of your work injury. Sometimes, an injured worker will go to the doctor or get a medicine prescription for something which is not work related. Those bills are not the responsibility of your employer’s Workers’ Compensation insurance carrier. However, sometimes there is a dispute about the bill. In that situation, it is the responsibility of the medical provider to prove that his bill is work related. A Workers’ Compensation medical bill is a bill about you which is the responsibility of your employers’ workers’ compensation insurance carrier. It is not your bill.

How fast can I get my money?

The severity of your injury and the time that it takes you to recover will determine the actual date of resolution of your case. We don’t get paid until your case is settled or goes to trial.
